As of 1 February, amendments to the Civil Code regarding intellectual property rights have entered into force.
On 1 February, Law No. 4671-IX “On Amendments to the Civil Code of Ukraine Regarding the Improvement of Certain Provisions Concerning Intellectual Property Rights” entered into force.
The Law was officially published in the Voice of Ukraine newspaper on 31 January 2026.
Key amendments:
- Part two of Article 190, which provided that property rights are a non-consumable thing and are recognized as proprietary rights in rem, has been deleted.
- Part one of Article 421 has been restated to provide that the subjects of intellectual property rights are: the creator(s) of the intellectual property object (author, performer, inventor, etc.) and other participants in civil relations who hold personal non-property and/or property intellectual property rights in accordance with this Code, other law, or a contract.
- Article 429 “Intellectual Property Rights to an Object Created in Connection with the Performance of an Employment Agreement (Contract) or Military Service” has been restated in a new version:
- Personal non-property intellectual property rights belong to the employee (servicemember) who created the object. In cases provided by law, certain personal non-property intellectual property rights to such an object may belong to the legal or natural person where or for whom the employee works.
- Property rights to an object created under an employment agreement belong jointly to the employee and the employer, unless otherwise provided by the Code or by contract. For objects created in connection with the performance of official duties during military service, property rights belong to the entity determined by law.
- Specifics of exercising property rights may be established by law.
- It has been clarified that property intellectual property rights to a work created in connection with the performance of an employment agreement (contract) are transferred in full to the legal or natural person where or for whom the author works from the moment of creation of such work, unless otherwise provided by contract or law (new wording of part three of Article 440).
