Employee Reservation: Eligibility Criteria for Important Enterprises in the Energy Sector Expanded

14/10/2026

The criteria for determining enterprises of significant importance to the energy sector of the national economy have been updated. By Order No. 400 dated 26 August 2026, which entered into force on 29 September 2026, the Ministry of Energy introduced amendments to its Order No. 475 dated 19 December 2024.

The amendments expand the existing criteria by introducing a new category of business entities. Under the revised rules, enterprises with foreign investment that construct production facilities for manufacturing energy equipment intended for repair, restoration and engineering works in the energy and gas transmission systems may be recognized as having significant importance to the relevant sector of the national economy.

Prior to these amendments, the criteria covered, among others, enterprises managing critical infrastructure facilities in the fuel and energy sector, business entities under the management of the Ministry of Energy, and certain enterprises whose activities are related to ensuring the operation of specialized energy facilities.

The expanded criteria are intended to identify enterprises that may meet the Ministry of Energy’s sector-specific requirements and, accordingly, qualify to reserve their employees from mobilization in accordance with Ukrainian legislation governing mobilization preparation and mobilization.
