From 1 July, the State Labour Service Will Monitor Compliance with the Disability Employment Quota Under a New Procedure

Ensuring the right of persons with disabilities to employment remains one of the key priorities of Ukraine’s social policy. At the same time, the absence of clearly regulated control procedures and detailed inspection rules has long created legal uncertainty for both employers and supervisory authorities.

To address these issues, the Cabinet of Ministers of Ukraine adopted Resolution No. 659 dated 27 May 2026, approving the Procedure for Monitoring Compliance with the Quota of Workplaces for the Employment of Persons with Disabilities and Conducting Employer Inspections in Relation to Such Compliance.

The Procedure establishes the framework for carrying out scheduled and unscheduled state control measures, defines the rights and obligations of inspection participants, sets inspection timelines, and regulates the process for documenting inspection results. The new Procedure will apply to inspections concerning compliance with the employment quota for reporting periods beginning on 1 July 2026.

The Procedure introduces a risk-based approach to inspection planning and provides an exhaustive list of grounds for conducting unscheduled inspections. At the same time, considerable attention is given to safeguarding employers’ procedural rights. In particular, an employer is entitled to deny access to officials of the State Labour Service if the statutory requirements regarding notification of the inspection, issuance of the inspection authorization, or the prescribed inspection frequency have not been complied with.

Following the inspection, an inspection report will be prepared, and where violations are identified, the employer will be issued an order requiring the elimination of such violations.
