Military records at enterprises

The Decree of the Cabinet of Ministers of Ukraine № 1487 from 2022 December, 30 approved a new Procedure for organizing and maintaining military records of conscripts and reservists (hereinafter – the Procedure), which defines the mechanism of organizing and keeping military records of conscripts and reservists by enterprises.

From January 5, all enterprises are obliged:

  • to submit information (personal and official data) about the company's employees to the authorities of the Unified State Register of conscripts and reservists;
  • to keep lists of employees according to military records;
  • to carry out measures to ensure compliance with the established rules of military records by the employees of the enterprise.

The directors of the enterprises are obliged to notify the employees about the conscription and provide them with an order about it being confirmed their signature.

All conscript men over the age of 16, reservists and female medics will be considered for registration.

The list of information submitted to the relevant authorities has been expanded by the Procedure. The deadlines for submitting relevant information have been shortened.

Lists for keeping personal records of conscripts at the enterprise have been introduced, as well as the dates of signing and registration of such lists have been established.

For internally displaced persons (IDPs), employment is possible only after registration as an IDP.

Acceptance for work and inclusion in personal registration at the enterprise are carried out only after a person is included in military registration.

Requirements for employees responsible for keeping military records at the enterprise

The organization and responsibility for military records at the enterprise rests with the relevant directors of enterprises, and the duties of military recording - with the employees of the HR department. In the absence of such a department - with a qualified person for additional payment of up to 50 percent of the official salary.

Qualification requirements have been established for persons engaged in military records at the enterprise.

Such functions cannot be entrusted to providers who offer consulting services on personnel and accounting issues.

Fines

The legislation provides for the following consequences in case of violation of the requirements of the Procedure:

  • for the first violation of the requirements, a fine in the amount of UAH 1 700 to UAH 5 100;
  • for a repeated violation within a year, a fine from UAH 3 400 to UAH 8 500.
