On 21 August 2025, the Verkhovna Rada adopted draft law No. 13388 in the second reading and as a whole, introducing changes to the procedure for suspending certain provisions of collective agreements during martial law.
Previously, an employer could unilaterally suspend the effect of specific provisions of a collective agreement. The new rules stipulate that such a decision is now only possible with the mutual consent of the parties and in the manner prescribed by the collective agreement itself.
In addition, within three months after the law enters into force, the parties are required to hold negotiations on the reinstatement of any suspended provisions. If a joint decision is reached, the employer must notify the authority that carried out the registration of the agreement within one week.
According to the authors of the law, these amendments improve the procedure for suspending provisions of collective agreements, make it more balanced, and help streamline the situation regarding agreements that were suspended during martial law.
