The Parliament Adopted a Law on Counting Insurance Service Period During Forced Absence
On 3 December 2025, the Verkhovna Rada of Ukraine adopted in the second reading and as a whole draft law No. 11488-1 “On Amendments to Certain Legislative Acts of Ukraine Regarding the Establishment of Continuity of the Insurance Service Period for a Person Reinstated After Unlawful Dismissal.” A total of 267 Members of Parliament voted in favour of the decision.
The adopted draft law provides for the following:
- counting towards the insurance service period for pension calculation the time during which an employee was unlawfully dismissed and later reinstated by a court decision;
- the employer’s obligation to pay the Unified Social Contribution (USC) for this period;
- determining the procedure for calculating the USC in cases of additional payments to wages for lower-paid work or for average earnings during forced absence;
- payment of the USC for each month of absence in an amount not less than the minimum insurance contribution;
- regulating the procedure for compensation for unused vacation days.
Thus, the implementation of this mechanism is expected to become an important step towards ensuring social justice and protecting employees’ rights in Ukraine.
