Ukraine Introduces a Transparent and Digital System for Business Inspections.
The President has signed Law No. 4840-IX dated 8 April 2026 “On the Fundamental Principles of State Supervision (Control)”, which systematically transforms the approach to business inspections. The Law shifts control from a punitive mechanism to a service-oriented model, where the key principles are prevention of violations, digital transparency, and the presumption of lawfulness of business activities. At the same time, the scope of the new Law does not extend to certain areas, including tax and customs control.
One of the key innovations is the establishment of an Integrated Information and Communication System that will automate all stages of inspections — from planning to publication of results. A risk-based classification of businesses is also introduced: the frequency of inspections will depend on the assigned risk level, ranging from one year for high-risk entities to five years for low-risk entities. At the same time, the risk rating itself will remain confidential and will be accessible only to businesses through their electronic cabinet.
The Law strengthens safeguards for businesses during inspections: inspectors are required to carry out video recording, and are prohibited from requesting documents that have already been submitted or from seizing original documents. In addition, a new supervisory tool is introduced — voluntary compliance audit without sanctions, allowing companies to independently identify and eliminate violations. It is also provided that suspension of business activity may only be ordered by a court, while in the case of a first violation, the minimum sanction applies. The Law will enter into force after the termination of martial law.
