Ukrainian Companies Can Report Loss of Control Over Property in Occupied Territories

In the context of Russia's aggression, Ukrainian businesses face not only the destruction or damage of their assets, but also the loss of the ability to use property located in temporarily occupied territories. On 27 August 2026, the Register of Damage for Ukraine opened a new category for claims, C3.2 “Loss of Control Over Property in Temporarily Occupied Territories”. It covers cases where a company has lost the ability to possess, use or dispose of its assets as a result of occupation, even if the property itself has not been destroyed or damaged.

A claim may be submitted by a legal entity registered in Ukraine that owns or co-owns the property. This right is also available to legal entities that hold the asset under the right of operational management, full economic control or usufruct. Each co-owner may independently submit a claim regarding the loss of control over its respective share.

The mandatory conditions include the property being located in a temporarily occupied territory, the loss of access to or control over the property as a result of Russia's internationally wrongful acts after 24 February 2022, and the existence of a legal right to the relevant asset. The category covers immovable, movable and other tangible property.

The claim is submitted electronically through the Diia Portal by a representative of the legal entity. Supporting documents may be attached, including documents confirming the legal right to the property, the fact of loss of control and the amount of damages, such as valuation reports, expert opinions, audit and inventory documents. This enables businesses to officially document the loss of control over their assets and build an evidentiary basis for the subsequent compensation process.
