Updated rules for employment of foreigners

The Law "On Amendments to Certain Laws of Ukraine Regarding Employment of Foreigners and Stateless Persons in Ukraine and Provision of Mediation Services in Employment Abroad" entered into force on the 15th of October, 2022.

The law changed the procedure for issuing or extending work permits for foreigners and stateless persons, refusal to issue or extending the validity of such permits, and established equal terms of payment for both citizens of Ukraine and foreigners and stateless persons.

In particular, the concept of foreign highly paid professionals (which also excludes the mandatory salary level of at least 50 minimum), foreign IT professionals, and foreign workers in creative professions is excluded from the Law. Only the general category remains - a foreign employee.

The labor of foreigners and stateless persons may be used in different positions at one or more (two or more) employers, provided that each employer obtains a permit to use the labor of foreigners and stateless persons in Ukraine. Previously, a permit for the employment of foreigners was required for each position.

The work of foreigners and stateless persons may be used without a permit in part-time positions at one employer, if the term of the employment contract for the part-time position does not exceed the term of the permit at the main place of work.
